Max Cashback – Terms and Conditions

1. Introduction

These Terms and Conditions govern the use of Max Cashback (“Service”), a cashback and rewards program that enables registered members to earn cashback on purchases made through participating merchants. By joining and using Max Cashback, users agree to be bound by these Terms and Conditions.

2. Definitions

  • “Member” refers to a registered user of Max Cashback.
  • “Participating Merchant” refers to any third-party retailer, brand, or service provider offering cashback through Max Cashback.
  • “Rewards” refers to cashback or other incentives earned through qualifying transactions.
  • “Qualifying Transaction” refers to an eligible purchase or action that qualifies for cashback under these Terms.

3. Membership

  • Membership is free and open to individuals who are at least 15 years old. Users under 18 must have parental or guardian consent.
  • Businesses with a registered Australian Business Number (ABN) may also join.
  • Members must provide accurate and complete information during registration and maintain one account per person.
  • A maximum of six accounts is allowed per postal address.

4. Earning Cashback

  • Cashback is earned when a member makes a Qualifying Transaction through an activation link provided by Max Cashback.
  • The cashback amount is determined by the commission paid by the Participating Merchant.
  • Transactions made using ad-blocking software, disabled cookies, or other tracking issues may not be eligible for cashback.
  • Cashback will be credited only if the Participating Merchant confirms and pays Max Cashback its commission for the transaction.
  • Approval times vary by merchant and may take up to 90 days or more.

5. Tracking and Claiming Cashback

  • Transactions should show as pending within seven days. If a transaction is missing, members must file a claim within 60 days of the purchase.
  • Tracking failures due to technical errors, improper redirection, or third-party interference may result in loss of cashback eligibility.
  • Max Cashback is not liable for transactions that are not tracked due to user error or system limitations.

6. Withdrawal of Cashback

  • Members can withdraw approved cashback once their balance reaches the minimum threshold specified on the website.
  • Payment is made via bank transfer, PayPal, or other available methods.
  • Incorrect payout details may result in loss of cashback, for which Max Cashback is not responsible.

7. Account Security

  • Members must keep their account credentials confidential and use unique passwords.
  • Two-factor authentication (2FA) is required for added security.
  • Unauthorized use of an account may lead to suspension or termination.

8. Fraud and Misuse

  • Fraudulent, deceptive, or dishonest activities, including multiple accounts, unauthorized referrals, or misuse of promotions, will result in account termination and forfeiture of cashback.
  • Max Cashback reserves the right to investigate any suspicious activity and take necessary action.

9. Changes to Terms and Services

  • Max Cashback may modify these Terms at any time. Substantial changes will be communicated via the website or email with at least 30 days’ notice.
  • Continued use of the Service after changes are made constitutes acceptance of the new Terms.

10. Termination and Inactivity

  • Accounts inactive for 12 months may be terminated, and any unredeemed cashback may expire.
  • Members may terminate their account at any time. Upon termination, any pending cashback may be forfeited.

11. Liability and Disclaimers

  • Max Cashback is not responsible for Participating Merchants’ actions, product quality, availability, or pricing.
  • Liability is limited to $1,000 for any claim arising under these Terms.
  • Max Cashback is not liable for system failures, tracking errors, or delays in cashback approvals.

12. Privacy and Data Use

  • Members’ personal data is handled in accordance with Max Cashback’s Privacy Policy.
  • Personal data may be shared with Participating Merchants and service providers to facilitate cashback tracking and payments.

13. Governing Law

  • These Terms are governed by the laws of New South Wales, Australia.
  • Any disputes shall be resolved in the courts of New South Wales.
